Ombudsman gives widest possible access to SALNs

MANILA, Philippines - The Office of the Ombudsman has issued new guidelines that will allow the public the widest access to government officials’ statement of assets, liabilities and net worth (SALNs).
Assistant Ombudsman Asryman Rafanan said Memorandum Circular No. 3 dated September 11, 2012 subscribes to the shift from “everything is secret unless allowed” to “everything is open unless restricted.”
Assistant Ombudsman Evelyn Baliton explained that in the past, the old rules only identify three types of requests: media request, student research and court subpoena. This time, all requests shall be granted except if, among others, the purpose is contrary to law, morals or public policy.
The SALN could also not be used for commercial purposes except for news and media purposes. The request can’t also be granted if it was made out of sheer idle curiosity.
The request will also be dismissed if the identity of the person asking for the record is fictitious or if he or she has derogatory records of having misused information issued previously.
The request will also be denied if there are grounds showing it was made with a plainly discernible improper motive and other analogous circumstances, such as harassment.
The Ombudsman can only issue SALNs that are in its actual possession.
The requester is also asked to indicate in a form his or her reservation as to making known to the owner of the SALN his or her background. The public official, however, is allowed to demonstrate that the request is a violation of his or her rights.
“All the requester needs to do is to subscribe the SALN Request Form (downloadable from the website), present the required identification cards, and pay minimal reproduction/certification fees,” Rafanan added.
The requester is required to present the original of at least two IDs, one of which is a government-issued ID bearing his picture and signature; and in case of members of the press, the other ID should be an official Press ID with proof of affiliation or accreditation as a legitimate media practitioner.  In case of student-requesters, a current Student ID with an indorsement from the proper school authorities shall suffice.
The new rules will take effect October 15.

Palace assures safety of diplomats amidst anti-US attacks

Malacañang assured the safety of the Embassy of the United States and its diplomats serving in the country in the midst of continuous anti-US attacks around the globe.
According to GMA News Online, deputy presidential spokesperson Abigail Valte guaranteed that the US officials are safe in the country and they need not flee.
“Of course envoys and US Embassy personnel in the Philippines don’t need to flee,” she said in an interview, “There’s no such danger against them in Manila and the Philippines. The government can guarantee the safety of the US Embassy.”
The Star has reported that the Philippine National Police have already heightened their presence outside the US Embassy in Manila and that the embassy officials themselves have increased their own security following the directive of US President Barack Obama to all their embassies abroad.
Valte also noted that the behavior of the Muslim communities should not cause alarm to the US embassy.
“Our [Muslim brothers] behave with civility and sobriety and goodwill,” she said.
Activists in Muslim cities conducted anti-US protests against the American-produced amateur film “Innocence of Muslim” shown on YouTube which depicted the prophet Muhammad as a womanizer.
Muslims considered the movie blasphemous and started targeting symbols of US influence like embassies, schools and fast food chains, according to ABS-CBN News.
The rocket attack against the embassy in Benghazi, which caused the death of US Ambassador to Libya J. Christopher Stevens and three other embassy staff, is considered one of the most violent acts triggered by the controversial film.
The Philippine Department of Foreign Affairs condemned the attack and said that it was "a serious violation of longstanding norms of international law with deep historical roots that diplomatic and consular agents are not to be harmed and that the diplomatic and consular premises are inviolable."
The activists have reportedly not ended their protests. A SITE Intelligence Group reported on Saturday that Al-Qaeda in the Arabian Peninsula called for more violence against US diplomatic missions in the Middle East and Africa, and urged Muslims in the West to attack US interests.
Meanwhile, Valte said the government is unlikely to request Google to restrict the access of Filipinos to the controversial film on Google-owned video sharing site.
Valte said in a statement that she does not see the anti-Islam video affecting the consciousness of Muslims in the country.
She also added that numerous YouTube videos may be considered offensive by some sectors, but the government has never asked to take anything down.
“In the entire two years and odd number of months [that President Benigno Aquino III] has been in office, the administration has never asked to take down anything,” Valte said.
In Muslim countries like Indonesia, Libya, Egypt, and India, Google has already blocked access to the anti-Islamic film.

MANILA, Philippines - Reelectionist senators Loren Legarda and Francis Escudero are still the top senatorial candidates in the midterm elections in 2013, according to the latest Pulse Asia survey.
Based on the survey, conducted from August 31 to September 7, Legarda and Escudero still lead the list of senatorial candidates.
Also in the top 10 list are Alan Peter Cayetano, Antonio Trillanes IV, Gregorio Honasan and Aquilino Pimentel III.
Former senators Miguel Zubiri, Richard Gordon, Jun Magsaysay and Jamby Madrigal and Aurora Rep. Sonny Angara, former Las Piñas Rep. Cynthia Villar, and Nancy Binay, Vice President Jejomar Binay's daughter, entered the top 15 senatorial bets.
Those in the top 20 senatorial candidates are San Juan Rep. JV Ejercito, Cagayan Valley Rep. Jack Enrile , Justice Secretary Leila De Lima, ex-Akbayan partylist Rep. Risa Hontiveros, Customs Commissioner Ruffy Biazon, Movie and Television Review and Classification Board chairperson Grace Poe-Llamanzares and journalist Mon Tulfo.
Legarda had run for vice president in 2010 but lost to Binay. Escudero, on the other hand, is said to be aspiring for a higher post in 2016. Escudero had campaigned for Binay in 2010.
Cayetano, Trillanes, Honasan and Pimentel are incumbent senators.
In June, Legarda and Escudero also topped Pulse Asia's senatorial survey.
